A CHARTER ORDINANCE EXEMPTING THE CITY OF HILLSBORO, KANSAS, FROM A PART OF THE PROVISIONS OF K.S.A. 12-834, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT; RELATING TO THE ISSUANCE OF GENERAL OBLIGATION BONDS FOR THE PURPOSE OF PUBLIC IMPROVEMENTS.
Section 1. The City of Hillsboro, Kansas, a mayor-council city of the second class, by the power invested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and exempts itself from, and makes inapplicable to it Section 12-834, Kansas Statutes Annotated, relating to the issuance of general obligation bonds for the purpose of public improvements, which statute applies to the City of Hillsboro, Kansas but is not uniformly applicable to, all cities in the State of Kansas, and to provide substitute and additional provisions as hereinafter provided.
Section 2. In lieu of the provisions of K.S.A. 12-834, the following shall be enacted:
The governing body of the City of Hillsboro, Kansas, may for the purpose of paying the costs of purchasing, or for the improvement, repair or extension of any waterworks, natural gas, telephone, sewage disposal, electric or other public utility owned by the city, and for the purpose of rebuilding, adding to or extending to the same from time to time, as the necessities of the city may require, borrow money and issue bonds of such city for the purpose of paying for any of the improvements mentioned herein and the land necessary therefore without such bonds having been authorized by a vote of the electors of the city.
