CHAPTER 1. ADMINISTRATIONCHAPTER 1. ADMINISTRATION\Article 4. Oaths and Bonds

All officers and employees of the city, whether elected or appointed, either under the laws of the State of Kansas or ordinances of the city, shall before entering upon the duties of their respective offices, take and subscribe an oath or affirmation as follows:

Oath: “I do solemnly swear (or affirm, as the case may be) that I will support the Constitution of the United States and the Constitution of the State of Kansas and faithfully discharge the duties of (here enter name of office or position). So help me God.”

Affirmation: “I do solemnly, sincerely and truly declare and affirm that I will support the Constitution of the United States and of the State of Kansas and faithfully discharge the duties of (enter name of office or position). This I do under the pains and penalties of perjury.”

All officers and employees required by law to take and subscribe or file any oath or affirmation shall be supplied the necessary forms for the purpose at the expense of the city and upon taking and subscribing or signing any such oath or affirmation, the same shall be deposited with the city clerk; provided, that the oath of the city clerk, required by section 1-401 of this article, shall be filed with the city treasurer. /

The following city officers shall each, before entering upon the duties of his or her office, give a good and sufficient surely company bond or personal bond to the city, before the officer shall begin the performance of his or her duties. Such bonds shall be in the following amounts to wit:

(a)   City Clerk      $25,000

(b)   City Administrator/City Treasurer       $102,500

(c)   Deputy City Clerk      $15,000

(d)   Municipal Judge        $1,000

(d)   Court Clerk    $1,000

(f)   Treasurer of Recreation Commission   $1,000

(g)   Recreation Director    $2,000

(h)   Treasurer of Fireman’s Relief Association       $1,000

(i)    Treasurer of Library Board     $1,000

(j)    Billing Clerk  $15,000

(k)   Reception Clerk         $15,000

(l)    Pool Manager $1,000

The bonds of the city clerk, city treasurer and municipal judge shall be surety bonds, and shall be approved by the governing body, and shall be filed with the city clerk, except the clerk’s bond, which shall be filed with the city treasurer. The bonds of any other officers, except as otherwise provided, shall be personal or surety bonds as may be determined by the governing body, and shall be approved as to form by the city attorney and filed with the city clerk.

No person shall perform any of the duties of the office which is appointed without first having given the bond as herein required, and after its approval by the governing body. Giving of a bond, if a bond is required, shall be considered as one of the qualifications necessary to be made in qualifying for office.

No person shall continue to perform the duties of any office for which a bond is required after the bond has expired or has been canceled or otherwise is not in effect, unless the bond has been renewed or another bond has been given and approved, it being the intention of this section to provide that no person shall perform the duties of an office for which a bond is required, unless a bond as required, is in force.

Nothing herein shall be considered as affecting any bond now in force, except that if the bond in force is not in an amount as great as herein required, the official, officer or employee is hereby required to increase the amount of the bond to meet the requirements of this article.

The city shall pay the premium on all bonds required under this article.
