CHAPTER 7. FIRECHAPTER 7. FIRE\Article 3. Emergency Assistance To Other Jurisdictions

In the event of a disaster when there is a request for assistance, if the city can provide assistance without unduly jeopardizing the protection of its own community, this action hereby authorizes the city superintendent or his or her designee, to provide such assistance as may be required under authority granted in Chapter 75 of the 1994 Session Laws of Kansas, with all the privileges and immunities provided therein.

Nothing in this article is intended to conflict or circumvent any existing inter-local agreement, any automatic aid, intergovernmental or mutual aid agreement, or any authority to enter into those in the future.

It is the intent of this article to provide assistance in any form of service including, but not limited to police, fire, EMS, public works, administrative and clerical during times of disaster as defined in Chapter 75 of the 1994 Session Laws of Kansas, with all the privileges and immunities described therein.

(a)   The city of Hillsboro, Kansas has approved and authorized the mayor and city clerk to execute, deliver and attest to the execution of fire protection agreements with Liberty township, Lehigh township, Menno township, Risley township, and the city of Lehigh, all of Marion County, Kansas.

(b)   The City is hereby authorized to enter into the Fire Protection Agreements (as defined above), and the Mayor is hereby authorized and directed to execute and deliver the Fire Protection Agreement for and on behalf of and as the act and deed of the City in substantially the form as it is presented today with such minor corrections or amendments thereto as the Mayor shall approve, which approval shall be evidenced by his or her execution thereof, and such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the purposes and intent of this article. The City Clerk or any Deputy City Clerk of the City is hereby authorized and directed to attest the execution of the Fire Protection Agreements and such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the intent of this section.

(c)   The City shall, and the officers, agents and employees of the City are hereby authorized and directed to, take such action, expend such funds and execute such other documents, certificates and instruments as may be necessary or desirable to carry out and comply with the provisions of this article and to carry out, comply with and perform the duties of the City with respect to the Fire Protection Agreements, all as necessary to carry out and give effect to the transaction contemplated hereby and thereby.
